Terms and Conditions: Early Adopter Program
Effective Date: April 4, 2026
Welcome to the Early Adopter Program for Streak Stories. These Terms and Conditions (“Terms”) constitute a legal agreement between Pockvue Solutions Inc. (“Company,” “we,” “us,” or “our”) and you (“User” or “Parent”). By paying the Reservation Fee, you agree to be bound by these Terms.
1. The Early Adopter Offer
By participating in this program, you are securing a First-Year Discount for a future subscription to our storytelling app.
• The Reservation Fee: You agree to pay a one-time fee (the “Reservation Fee”) to lock in your discounted rate.
• The Benefit: This fee entitles you to a discount on the standard annual subscription rate for your first year of use, starting upon the official launch.
2. Refund Policy
We value your trust. The Reservation Fee is fully refundable at any time during the beta testing phase of the application.
To request a refund, please contact support@streakcard.com. All refunds will be processed via Stripe to the original payment method.
3. Eligibility & Children's Privacy
• Adults Only: This program and website are intended solely for parents, legal guardians, and adults over the age of 18.
• Data Collection: We only collect parent/guardian information (name, email, phone number, and payment info). We do not knowingly collect personal information from children under 13 at this stage. By signing up, you affirm you are not providing any information belonging to a minor.
4. Delivery & Beta Access
• Promised Delivery: We intend to deliver the App by June 10, 2026.
• The Deliverable: Delivery consists of an App Store download link and a unique Beta Access Code sent to your registered email address.
• FTC Compliance: If delivery is delayed beyond June 10, 2026, we will notify you via email. Per US Federal Trade Commission (FTC) rules, you will have the option to either consent to the delay or cancel your reservation for a full refund.
5. Term and Termination
These Terms remain in effect from the moment of payment until the App is delivered or your reservation is cancelled. We reserve the right to terminate your participation and refund your fee if we suspect fraudulent activity or a breach of these Terms.
6. Reservation of Rights
Pockvue Solutions Inc. retains all right, title, and interest in and to the App, including all stories, characters, graphics, audio, and code. Your participation grants you no ownership or intellectual property rights.
7. Third-Party Content and Functions
• Stripe: Payments are processed via Stripe. We are not responsible for Stripe's service interruptions or their independent data handling.
• App Stores: Delivery is subject to the terms and availability of the Apple App Store or Google Play Store.
8. Disclaimer of Warranties
The Early Adopter Program and the upcoming Beta access are provided on an “as-is” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.
9. Limitation of Liability
To the maximum extent permitted by law, Pockvue Solutions Inc. shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising from these Terms shall not exceed the amount of the Reservation Fee actually paid by you.
10. Indemnification
You agree to indemnify and hold harmless Pockvue Solutions Inc. from any claims, losses, or legal fees resulting from your violation of these Terms or misuse of the Early Adopter Program.
11. Injunctive Relief
You acknowledge that a breach of Section 6 (Reservation of Rights) would cause irreparable harm for which money damages would be inadequate, and we shall be entitled to seek injunctive relief to stop such breach.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, USA. Any legal action shall be brought exclusively in the state or federal courts located in that jurisdiction.
13. Miscellaneous
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
• Entire Agreement: These Terms constitute the entire agreement between the parties.
• Updates: We may update these Terms by posting them on our website.
